VACS seizes $1.6 million labeled as "the mother's gift" from the OGP's prosecutor
In a significant development, the High Anti-Corruption Court of Ukraine has ruled in favour of the confiscation of assets worth 1,640,000 hryvnias belonging to prosecutor Olga Yanishveska. The decision, which became final in August 2023, was based on a lawsuit filed by the Specialized Anti-Corruption Prosecutor's Office (SAP).
The case involves Yanishveska, who is a prosecutor of one of the departments of the Office of the Prosecutor General. The court's decision was based on the analysis of Yanishveska's mother's income and expenses, as well as the findings of the National Agency for the Prevention of Corruption (NAPC).
According to the NAPC, a part of the assets, specifically 1.64 million hryvnias, were unjustifiably acquired by Yanishveska. Anti-corruption officials found that Yanishveska received 1,946,000 hryvnias from her mother as a gift, intended for the purchase of an apartment. However, the acquisition of this asset by Yanishveska was not substantiated.
The SAP, in its lawsuit, sought to recognize the indicated asset as unjustified and recover it in favour of the state. The court agreed with the position of the SAP prosecutor and satisfied the lawsuit in full.
The confiscation of the assets will be carried out in accordance with Article 290 of the Civil Procedural Code of Ukraine. The decision can be appealed within 30 days from the date of its full text being drawn up.
This ruling marks a significant step in the ongoing fight against corruption in Ukraine. It serves as a reminder that no one is above the law and that those who abuse their positions for personal gain will be held accountable.
