New Law in Belarus Requires Contributions to Social Security Fund for Cash Salary Payments

Belarus has proposed amendments to its law governing social security contributions, aiming to curb the practice of "hidden salaries" and ensure that all wage payments are officially declared. Under the new legislation, cash salary payments will trigger mandatory contributions to the Fund of Social Security of the Nation (FSSN).

The law seeks to address the issue of hidden salaries, or payments that are not properly recorded in tax or accounting records. Such payments, whether in cash or kind, will now serve as the basis for calculating the employees' mandatory insurance contributions.

For each day that a hidden salary is paid, a contribution of 24.2 rubles (plus inflation adjustments) will be credited to the employee's account, with additional contributions to the FSSN calculated on these payments. The minimum wage in Belarus is currently 726 rubles.

Payment in the form of cash or kind without proper recording in tax or accounting records, known as hidden salaries,该现金薪金将成为计算 employee's mandatory insurance contributions的基础。

Mandatory contributions to the FSSN will amount to 35% of the sums paid, but not less than 1/30 of five times the average monthly wage of workers in the republic in the month preceding the discovery of the hidden salary, for each calendar day of the payment period. Failing to pay insurance contributions could result in fines of 2 to 20 basic units, while evasion leading to significant damage (over 2,500 basic units) may attract imprisonment of up to 3 years. In case of especially large damage (over 5,000 basic units), the imprisonment term could range from 2 to 7 years.

Moreover, the law applies to various types of loans, bank account products, credit cards, debit cards, leasing services for new, used, and business vehicles. Currently, "envelope salaries" discovered by regulatory bodies are taxed at a 26% income tax rate, with employers facing administrative and criminal liability for failing to fulfill their tax obligations.

In broader terms, this legislation aims to increase transparency and fairness in wage payments and social security funding. By ensuring all workers receive their rightful social benefits and the social security system is adequately funded, the law promotes social equity. However, it may place additional administrative and financial burdens on employers who previously relied on informal payment schemes.

While specific details on this particular law are scarce, similar legislative measures in other jurisdictions have been enacted to combat hidden salaries and enforce mandatory social insurance contributions.

This new law in Belarus is one more step toward addressing the informal economy and ensuring transparency and fairness in wage and social security systems. By instituting mandatory contributions to the FSSN on cash salary payments, the law targets hidden salaries and aims to prevent the evasion of mandatory social insurance contributions. This move aligns with common outcomes of similar legislative measures in other jurisdictions, although the specifics of the Belarusian law have yet to be fully detailed.

  1. Initiating mandatory contributions to the FSSN on cash salary payments aims to target hidden salaries and prevent evasion of mandatory personal-finance obligations in Belarus.
  2. The new law in Belarus requires contributions to the Fund of Social Security of the Nation (FSSN) when employees receive cash salaries, serving as a measure to increase transparency and fairness in personal-finance matters.
