South Anhalt Employers in Construction Sector Facing Probation for Unlawful Activities

In a significant ruling, a 37-year-old man from Southern Saxony-Anhalt was convicted by the Koethen Local Court for withholding and misappropriating wages in 37 cases and committing fraud in 14 cases. The case, which involved 51 instances of wage manipulation and fraud, took place in Dessau-Roßlau and Koethen.

The investigations, conducted by the Financial Control Black Work Dessau of the Main Customs Office Magdeburg, revealed that the man employed workers whose wages were paid 'black' from March 2018 to April 2019. This action resulted in a combined loss of approximately 226,000 euros for various agencies.

The employer did not comply with social security obligations, leading to a total contribution loss for the social insurance agencies due to this action of around 131,000 euros. The man also failed to pay social security contributions to the holiday and wage equalization fund of the construction industry, SOKA-BAU, resulting in a total loss of almost 56,000 euros.

In addition, the employer did not register or incorrectly registered his employees with the health insurance companies, causing a tax loss of around 39,000 euros. The man was also found to have employed several workers as so-called pseudo-self-employed individuals.

The offenses occurred while the man was an employer in the construction industry. As a result of his actions, he was sentenced to one year in prison, suspended. The convicted person must pay a sum of 6,000 euros to the state of Saxony-Anhalt.

The Main Customs Office Magdeburg conducted the detailed investigations in this case, but the search results do not provide information about the name of the head of the main customs office (Hauptzollstelle) who led the investigations.

This conviction serves as a reminder of the importance of adhering to labour and tax laws, ensuring fair employment practices, and contributing to the necessary social security and tax obligations.
