Las Vegas Casinos Settle Religious Discrimination Charges with EEOC

The Aria Resort & Casino and Luxor Hotel & Casino in Las Vegas, Nevada, have settled religious discrimination charges with the U.S. Equal Employment Opportunity Commission (EEOC) over denying employees religious accommodations to their COVID-19 vaccine mandate policies.

Unlike the Venetian casino's settlement, which involved an $850,000 payment, the financial terms of the ARIA and Luxor settlements were not disclosed publicly. Both casinos entered into separate conciliation agreements without admitting liability.

As part of the settlement, ARIA and Luxor agreed to provide Title VII training specifically focused on religious accommodations to their human resources staff. The EEOC will monitor compliance with the agreements to ensure that the human resources teams better understand federal law requirements for reasonable religious accommodations.

The EEOC Las Vegas Local Director, Michael Mendoza, commended the MGM International-owned casinos for putting in place training measures that will have a lasting impact on workers seeking religious accommodations in the workplace.

The allegations against the MGM International-owned casinos involve a denial of religious accommodations to staff members who did not adhere to COVID vaccination policy. The Venetian Casino Resort previously settled a lawsuit over similar charges, involving a financial payment of $85,000.

The Aria and Luxor settlements occurred approximately one month after the Venetian's settlement. It's worth noting that the Aria and Luxor lawsuits did not specifically involve religious discrimination.

The EEOC continues to oversee cases of alleged discrimination in the workplace. The commission emphasizes the importance of all employers understanding that federal law requires reasonable religious accommodations. The commission will compliance-monitor the MGM International-owned casinos to ensure the agreed actions are carried out effectively.
