Commercial Vehicle Driver Faces Charges for Using Vice Grip on Brake Line

A commercial vehicle driver was stopped on Ontario's Highway 417 near Moodie Drive on Monday morning, after the Ontario Provincial Police (OPP) discovered that he was using a vice grip to hold the vehicle's brake line together. This is the second time this year that the driver has been stopped for the same offenses.

The incident occurred around 9 a.m., and the OPP stopped the vehicle for offenses related to the brake system. Following the stop, an inspection was performed by the Ministry of Transportation, which found that the vehicle had a compromised brake system. As a result, the vehicle has been taken out of service.

Using a vice grip to hold a brake line on a commercial vehicle is a serious safety violation that can lead to significant consequences for both the driver and the company. The driver faces legal penalties, including a minimum fine of $2,000 upon conviction, as well as the potential for the vehicle to be towed.

The company can also be held liable for negligent maintenance if it allowed the vehicle to be operated in an unsafe or unlawful condition. Liability may extend to lawsuits based on negligence per se, wherein the vehicle's unlawful condition is established and directly linked to an incident or accident. Companies must implement stringent vehicle maintenance policies and inspections to avoid such liability and reduce risks associated with employee vehicle use.

While exact statistics on the frequency of this specific issue (vice grips used on brake lines) are not provided, the emphasis in enforcement bulletins and substantial fines suggests that improper, temporary fixes on critical systems like brakes are treated seriously but are not uncommon enough to be overlooked by authorities. Traffic enforcement agencies frequently patrol commercial vehicles to catch such unsafe practices, indicating regulatory vigilance though not necessarily widespread occurrence.

The driver and his company are facing a total of nine charges. The charges are related to the driver's actions regarding the vehicle's brake system, and the case is currently under investigation. The OPP emphasizes the importance of safe vehicle operation, and companies are reminded to maintain their vehicles to legal standards to avoid penalties and keep the roads safe for all users.
