Firm obtains dismissal for Autoliv in a €770 million auto parts cartel case at the UK Competition Appeal Tribunal
White & Case Successfully Represents Autoliv in £620 Million Claim Dismissal
In a significant legal victory, global law firm White & Case has successfully represented Autoliv Inc., the world's largest automotive safety supplier, in a high-profile case against Stellantis. The UK Competition Appeal Tribunal (CAT) dismissed Stellantis' €770 million (approximately £620 million) damages claim against Autoliv on February 21, 2025.
The trial, which took place over five weeks in October 2024, saw White & Case assemble a formidable team of legal experts to defend Autoliv. Tilman Kuhn in Duesseldorf and Brussels, Raif Hassan, and Charles Balmain in London led the team, with associates Marlin Heitmann and Ellen Campbell, also based in London, providing crucial support.
Autoliv was the only defendant group remaining in the proceedings, as all other defendants had settled. The service areas of the White & Case team representing Autoliv included Antitrust/Competition, Litigation, Infrastructure, Transportation & Logistics, Western Europe, Germany, the United Kingdom, and Belgium.
Ellen Campbell, who specializes in Financial Restructuring and Insolvency, and Marlin Heitmann, a Litigation expert, played pivotal roles in the defence of Autoliv. Raif Hassan, an accomplished litigator with expertise in International Arbitration and Antitrust/Competition, led the strategic direction of the case. Charles Balmain, who specializes in International Arbitration, Litigation, Antitrust/Competition, Financial Restructuring and Insolvency, Sovereigns, and Enforcement of Arbitral Awards & Judgments, provided invaluable guidance throughout the proceedings.
The dismissal of the claim was a result of Autoliv failing to prove the infringement and overcharge alleged by Stellantis. This significant victory underscores White & Case's commitment to providing exceptional legal representation in complex, high-stakes cases.
The service area of Ellen Campbell is located in the United Kingdom, as is Marlin Heitmann's. Tilman Kuhn is based in Duesseldorf and Brussels, while Raif Hassan and Charles Balmain are based in London.
Initially, Autoliv was represented by Cleary Gottlieb Steen & Hamilton LLP in the UK cartel proceedings. However, White & Case LLP became involved in the case and successfully represented Autoliv in the subsequent proceedings at the CAT.
This victory marks a significant milestone for Autoliv and White & Case, demonstrating the power of a well-coordinated legal team in the face of complex and challenging legal battles.
