Increase in Unemployment Benefits Cases and Social Jurisdiction Cases in Baden-Württemberg
In Baden-Württemberg, Germany, the number of social jurisdiction cases has seen an increase, with a particular surge in unemployment benefits and basic security for job seekers cases. According to recent data, a total of 25,654 cases were closed in the last year, compared to 24,923 in 2023.
The rise in unemployment benefits cases can be attributed to a combination of economic and policy factors. Germany experienced a labor market weakening by mid-2025, with unemployment rates holding at 6.3%, near the highest since 2020. The number of unemployed people rose to nearly 3 million for the first time in a decade, reflecting broader economic challenges and reduced hiring demand.
Policy changes also played a significant role. In 2024, the German government increased unemployment benefit rates but ended certain supportive policies and reintroduced stricter sanctions. The minimum wage in Germany also increased, which while beneficial for employed workers, can affect labor market dynamics and potentially increase unemployment among lower-skilled workers.
The increase in cases is not directly related to the reduction in procedure duration. The Social Association VdK Baden-Württemberg attributes the reduction in procedure duration to lengthy medical investigations, which are a necessary part of social jurisdiction. These investigations provide essential expert opinions for the assessment of social legal disputes but contribute to the high duration of proceedings.
The largest increase in lawsuit entries was between 2023 and 2024, with an increase of 341 cases (plus 25%) in the area of long-term care insurance. Despite the increase in cases, the duration of proceedings in main proceedings in social courts of Baden-Württemberg has slightly decreased, from 13.9 months in 2023 to 13.2 months in 2024.
The Ministry of Justice in Stuttgart announced an increase in cases at the eight social courts in Baden-Württemberg in 2024. In proceedings for the granting of interim legal protection, the percentage increase was approximately twelve percent. The percentage increase in cases from this legal area in lawsuit proceedings was five percent.
The increase in cases and the reduction in procedure duration may pose challenges for labor market stability, social welfare sustainability, and the financial security of vulnerable populations. The reintroduction of total sanctions for non-compliance with job search obligations can have harsh effects on families' everyday expenses and children's well-being. The persistent reluctance of companies to hire combined with elevated unemployment and changes in benefit policy signals ongoing labor market fragility that may slow economic recovery efforts.
