Customs Inspects German Hotels and Catering Industry, Finds Wage Law Violations
Customs officials have conducted inspections across Germany, focusing on the hotel and catering industry. The Financial Control of Under-the-Table Work of the Customs (FKS) targeted businesses in the Aachen region and nationwide last Friday. The inspections aimed to ensure compliance with minimum wage laws and social security obligations, and to detect illegal employment and improper receipt of social benefits.
The FKS of the Main Customs Office Aachen inspected businesses in the city region of Aachen and the districts of Düren and Euskirchen. Since January 1, 2025, the general minimum wage has been €12.82 per hour, and employers must ensure they comply with this. The inspections were risk-oriented and could involve spot checks or full inspections of all employees.
The inspections resulted in eight administrative offence proceedings, including for not carrying identity documents and violating notification obligations. Additionally, four criminal proceedings were initiated for suspected wage withholding, misappropriation, and illegal employment of foreigners. A total of 41 employees were interviewed during the inspections. Following these inspections, extensive follow-up checks are carried out to verify employee data and business records.
The Customs places a particular emphasis on combating under-the-table work in the hotel and catering industry, which is subject to the Minimum Wage Act (MiLoG).
